TERMS OF SERVICE

These general Terms and Conditions apply to a consumer when products are purchased from us, SMW Group AS (“we”), reg. no. 40003495011, at our websites, such as www.smwwheels.com. By purchasing our product(s), confirmation is automatically provided that these Terms and Conditions are accepted.

When placing an order on the website, a purchase agreement is entered into between customer and us when we have confirmed the order in writing. We ask customers to save the order confirmation for future correspondence purposes.

PRICES AND PAYMENT

All applicable prices for products are specified at www.smwwheels.com. We reserve the right to make price adjustments; and updated prices will be published and held available at our websites. The prices include VAT.

In the event a product is listed at an incorrect price due to a typographical or technical error, or any other reason, we preserve the right to refuse or cancel any order placed for such product.

We currently accept Visa, MasterCard, AMEX and Apple Pay. We use 3D-Secure, developed by Visa and MasterCard, to securely process payments, and all payment information is encrypted using SSL encryption, which prevents unauthorized access to card details.

TERM AND RIGHT OF WITHDRAWAL

These Terms and Conditions are valid for each purchase made.

Customer has the right to withdraw the purchase within a period of 14 days from the day of delivery of the product for a substantial reason, to be confirmed by way of our review.

Provided that the product is sealed, unused and returned to us within 14 days intact and in its original packaging, we will repay the total costs of the product as well as costs for shipping and return, provided that the product is returned by regular mail.

A customer remains responsible for the products during transit when the product is returned to us, including the risks of damage or loss during delivery.

COMPLAINTS

If a damaged or defective product was received, a complaint can be initiated by e-mail: forged@smw.com. All complaints made within 14 days will be deemed as having been initiated on time.

We handle all complaints in accordance with applicable consumer protection legislation and with the guidelines provided by the Latvian Consumer Rights Protection Centre (“PTAC”) : www.ptac.gov.lv.

FORCE MAJEURE

We are not liable for defects or delays caused by circumstances beyond our reasonable control, such as general labour disputes, war, fire, amendments to regulations issued by governmental authorities, issues stemming from poor data transmissions.

CHANGES AND ADDITIONS

We reserve the right to change and make additions to these Terms and Conditions at any time. Changes and additions of these Terms and Conditions become valid for all purchases made after their publication at www.smwwheels.com.

We’re always delighted to see our products in real life on social medias, and sometimes we may request to share such pictures – to be published primarily on our website but may also be published on Instagram or other venues.

By responding to our request with the hashtag #SMWwheels, the following terms are deemed to be agreed upon:
A non-exclusive, royalty-free worldwide license is provided to SMW Group to use such pictures, including for purposes of marketing and / or advertising, not limited to the website gallery, newsletters, catalogues, e-mail and other customer communications, store materials and other marketing purposes. SMW Group is released from all obligations to pay for the use of such pictures and for the intellectual property rights associated with the above-described uses.

PROTECTION AND PRIVACY

We assume responsibility for all personal information that is provided to us or made available to us. Please see our Privacy Policy for more information on how we process personal data.

GOVERNING LAW AND DISPUTES

If a dispute should arise that we are not able to settle directly, we shall comply with PTAC recommendations in all the matters they examine. PTAC can be contacted through their website.

These Terms and Conditions shall be governed by and construed in accordance with the laws of Latvia. Any dispute arising out of these Terms and Conditions shall be settled accordingly.
